THIS AGREEMENT LIMITS OUR LIABILITY………PLEASE READ CAREFULLY________________       THIS AGREEMENT is made by and between Eastside Inspection Services (hereinafter referred to as EIS), and  the Client identified on page 3 of this agreement (hereinafter referred to as Client). In consideration of the promise and terms of this agreement, the parties agree as follows:  1. CLIENT, PROPERTY, & ESSENTIAL INFORMATION IDENTIFIED. The type and/or description, and location of the property (hereinafter referred to as Property), The owner/seller, the date, time and fee for the service, and the name of the individual inspector are also identified on page 3 of this agreement.

2. REQUEST, PURPOSE & SCOPE OF INSPECTION. Client requests, and EIS agrees to conduct a thorough but limited visual inspection of the Property, and to prepare and deliver a comprehensive written report of the apparent condition of the structure and the readily accessible and installed systems and components of the Property. The purpose of this inspection and associated report is to identify and disclose those areas of the structure, systems and components inspected, which, in the opinion of the inspector, are significantly deficient, unsafe, near the end of useful service life, or which reveal Wood Destroying Organism (WDO) or any Conditions Conducive to WDO. THE SCOPE OF THE INSPECTION IS LIMITED TO THE ITEMS LISTED WITHIN THE PAGES OF THE REPORT.

3. COMPLETE WOOD DESTROYING ORGANISM (WDO) INSPECTION INCLUDED* **Simultaneously, EIS will conduct a Complete WDO Inspection of the property and issue a written report of FINDINGS including a diagram and a description of the findings detailing the location of: (a) Visible evidence of damage and/or infestation by Wood Destroying Organism; (b) Conditions conducive to WDO; (c) Inaccessible areas; (d) Excluded areas. *Subject to LIMITATIONS OF INSPECTIONS detailed in the COMPLETE WDO REPORT FORM.**EIS is not in the pest control business, and does not provide repairs, corrective procedures, and treatments. 

4. OUTSIDE THE SCOPE – NOT INCLUDED. Community Association Common Elements are not included, and unless client specifically requests and EIS agrees, this inspection and report does not include and/or address, whether concealed or not, the following:

·Detached outbuildings – unless specifically included* ·Pool, hot tub, and spa systems – unless specifically included* ·Pool, tub, and spa bodies and underground piping·Building code or zoning ordinance violations ·Geological stability or soils condition ·Structural stability or engineering analysis ·Asbestos, radon, formaldehyde, lead, water, or air quality ·Electromagnetic radiation or any environmental hazards ·Building value appraisal or cost estimates  Specific components noted as being excluded ·Private water and sewage systems ·Saunas, steam baths and their fixtures and equipment ·Radio – controlled devices, automatic gates, elevators, lifts, dumbwaiters ·Thermostatic and time clock controls, security alarms ·Water softener / purifier systems and solar heating systems ·Furnace heat exchanges, freestanding appliances ·Adequacy or efficiency of systems and components ·Prediction of life expectancy of any item ·Personal propertyNote: Client is urged to contact a specialist for information, and/or testing of the above.                                                                           Page 1 of 3                         Client initial ________

STANDARDS / ETHICS:  This inspection will be performed in accordance with the current Standards of Practice, and Code of Ethics, of the American Society of Home Inspectors (ASHI), and the Washington State Pest Control Association (WSPCA). A copy of those standards and code will be included with the report.  6. CLIENT CONCERNS / ON SITE PRESENCE:  The opportunity for Client to enjoy a valuable learning experience exists only on-site at the time of the inspection. Client concerns can be addressed, and a greater understanding of the property and its care and maintenance, can be gained, only by fully participating in the inspection process. No written report can substitute for Client participation. It is virtually impossible to fully profile any property, with any reporting system, in the few hours allocated to the task. Client will not likely find a better opportunity to obtain useful information about the Property. 

7. LIMITATIONS – NOT EXPERTS:  This inspection and report is not technically exhaustive, nor is it a code compliance or engineering study. The inspector is a generalist and is not acting in any other capacity. EIS inspectors are conscientious, well-trained, experienced, and knowledgeable, but we are not engineers, architects, or environmental health professionals. We do not claim to be, nor hold ourselves out as expert in any field, trade, or craft.

8. LIMITATIONS – NO DESTRUCTIVE TESTING:  No area, system, or component, not readily exposed to view, is concealed, or is inaccessible for any reason, can be inspected and is therefore not included in this inspection. Limiting examples include; wall and floor coverings, fresh paint, personal items, furniture, automobiles, utilities shut off, locked doors, height, etc. Moving personal property, dismantling items, and destructive testing to enable viewing, are specifically excluded. 9. LIMITATIONS – TIMELY OBSERVATIONS ONLY:  This inspection is a limited visual inspection of the Property at a specific point in time. The report describes what was observed at the time of the inspection ONLY. Conditions can and do change, and bad things can happen to the Property within moments of the inspection. 10. USE BY OTHERS:  Client understands that this inspection and resulting report are for client’s sole use and benefit. With the following exceptions, and then for use in Clients transaction ONLY, Client agrees to NOT disclose or transfer any part of the inspection report on this Property, to any other person for any use. EXCEPTIONS: One copy each to; Seller, Client’s real estate agent, bank or lending institution, and attorney. No further use or disclosure is permitted without the written consent of EIS. 11. DISPUTE:  Client understands and agrees that any claim for failure to accurately report the visually discernable conditions at the Property, as limited herein above, shall be made in writing and be reported to EIS within ten (10) business days of discovery. Client further agrees that, with the exception of emergency conditions, Client, Client’s agents, employees and/or independent contractors, will make no alterations, modifications, or repairs to the item with the claimed discrepancy prior to a re-inspection by EIS. Client understands and agrees, that failure to notify EIS as stated, shall constitute a waiver of any and all claims for said failure to accurately report the condition in question. EIS will respond within 48 hours of notice. 

12. LIABILITY – LIMITATIONS ON:  Neither EIS nor its inspectors shall be held responsible or liable for any repairs to, or replacements for, any item, structure, system, or component at the Property that has failed its intended purpose. EXCEPT where there is a direct cause and effect from the inspectors action. EIS liability for mistakes or omissions in this inspection is limited to a refund of the fee paid for this inspection and report. The liability of EIS principals, agents, and employees is also limited to the fee paid. This limitation applies to anyone who is damaged or has to pay expenses of any kind because of mistakes or omissions in this inspection and report. This limitation on liability is binding on Client and Client’s spouse, heirs, principals, assigns, and anyone else who may otherwise claim though Client. Client assumes the risk of all losses greater than the fee paid for the inspection. Client agrees to immediately accept a refund of the fee as full settlement of any and all claims, which may arise from this inspection.

 13. ATTORNEY’S FEESThe prevailing party in any dispute arising out of this agreement, this inspection, or report shall be awarded all attorney’s fees, arbitrator’s fees, and any other associated costs. 
14. SEVERABILITY
Client and EIS agree that, should a Court of Competent Jurisdiction determine and declare that any portion of this agreement is void, or unenforceable, the remaining provisions and portions shall remain in full force and effect. 

15. ARBITRATION

Any dispute, controversy, interpretation or claim including claims for, but not limited to, breach of contract, any form of negligence, fraud or misrepresenting or arising out of, from or related to the inspection or the inspection report shall be submitted to final and binding arbitration under the Rules and Procedures of the Expedited Arbitration of Home Inspection Disputes  of  Construction Arbitration Services, Inc.  The decision of the Arbitrator appointed thereunder shall be final and binding and judgment on the Award may be entered in any court of competent jurisdiction.
